These General Sales Conditions in force, updated in the last quarter of 2017, are intended to regulate the terms and conditions governing the website www.saddle-room.com and the provision of the Online Shop service of “Saddle Room” headquartered at Rua da Fábrica 58 D, 2135-144 Porto Alto, Samora Correia, Portugal, Legal Person nº 504224387, hereinafter referred to as “Saddle Room”.

 

2. Browsing the website www.saddle-room.com, as well as the purchase of any product on the Online Store, implies acceptance of these General Conditions of Sale.

 

3. “Saddle Room” reserves the right to modify, without prior notice and at any time, the information and commercial offer presented on products, services, commercial conditions, promotions and prices.

 

4. The images that illustrate each product presented in the online store may differ from the product later delivered, and these same products are also subject to stockouts.

 

5. If any image of a product has a price reference, it may not correspond to the real value.

 

6. The mentioned values of foreign currencies (exchange rates) are merely indicative values/conversions, and “Saddle Room” is not responsible for the exact presentation of the values.

 

7. Despite efforts and monitoring of information on the online store, some products may have an inaccurate price, which is why we check prices whenever we process orders. Consequently, the prices shown on the website are merely indicative and do not constitute a contractual proposal. If the effective price of the product is lower or higher than the advertised price, "Saddle Room" will inform the customer of this situation by email and will await their decision to accept the new price or even cancel the order within 5 (five) working days from the date the order confirmation email was sent.

 

8. Under Portuguese legislation, all prices shown in € and include the respective VAT rates in force.

 

9. It is not possible to make purchases in the online store, whose value is equal to or less than the value of €5, regardless of the desired payment method.

 

10. Despite efforts to ensure that all product descriptions are correct, they may differ from individual interpretations. Despite the efforts of preservation and packaging for shipment, by "Saddle Room" some products may present changes in the color of their packaging, erasures and levels of wear, among others not mentioned, which does not mean lack of care or preservation, falsification, adulteration or counterfeiting. In the case of complaints or requests for return, the subject of which falls under this condition, we inform you that “Saddle Room” does not exchange or return the product(s), unless the damage to the packaging affects the product sold.

 

13. Promotions disclosed on the website www.saddle-room.com may not be applicable to the physical store, located at Rua da Fábrica 58 D, 2135-144 Porto Alto, Samora Correia, Portugal.

 

14. In order to place orders on the online store of the website www.saddle-room.com, it is mandatory to register as a user. With this we intend to keep the entire sales process clear and transparent under the Portuguese legislation in force. After registration, you can at any time consult your personal customer area, where you can view and edit personal data, order history or change the access password.

 

15. To order a product, just add the product(s) on the part of your page, indicating the desired quantity and, finally, clicking on the "Buy" button. Quantities can be changed before finalizing the order, as well as removing products from the Shopping Cart.

 

16. A summary of the order will always be displayed, before finalizing it, so that you can make a final analysis of it.

 

17. To the prices shown in the online store, add the value of shipping costs for each order, which are calculated based on the sum of the packaging cost and the shipping cost. The shipping cost depends on the weight of the order and its delivery destination. The total shipping costs will be automatically calculated when placing your order on the "Saddle Room" online store.

 

18. After confirming the order on the online store, an email will be sent to the contact address registered on the website www.saddle-room.com by the customer upon registration, with all details about delivery, billing, payment information, products and values. “Saddle Room” encourages you to confirm the details thereof, in order to identify any errors. If the customer does not receive the order confirmation email, he is asked to contact “Saddle Room”, through the means available on our contact page, so that the situation can be verified.

 

19. If an order cannot be fulfilled in part or in full, the customer will be immediately contacted by “Saddle Room” in order to find the most suitable solution.

 

20. Orders will only be processed after effective receipt of payment.

 

21. As a rule and after indication by email that the order has been shipped, the delivery can take at least about 72 hours to be delivered in Portugal-Continental, about 5 to 7 working days in Europe and between 5 to 30 days to reach the customs of countries in the rest of the world.

 

22. The payment methods that can be used to place orders at the “Saddle Room” online store are: Multibanco, MB Way, Visa or Mastercard.

 

23. The order itself does not constitute a definitive reservation of the products, although we make efforts to guarantee the products within a normal time window for payment, by methods other than credit cards. For ATM and MB Way modalities, so that there is time to travel to the places where payment can be made, we consider that 3 (three) days is a normal time for payment.

 

24. In the hypothetical situation of simultaneous purchases of the same product(s), whose stock is limited, in our online store and in our physical store, and whose online shopping process is completed without contrary indications, the online user will be contacted by “Saddle Room” in order to agree on the best way to resolve the issue (return policy or, if feasible, wait for stock after order from the customer).

 

25. Orders may be canceled, when expressly requested by the customer, by contacting geral@saddle-room.com, prior to their dispatch. After confirming the order, the customer is asked to contact “Saddle Room”, as soon as possible, in order to find the most suitable solution.

 

26. You can follow the status of your orders in your Customer Area, in the Order History section.

 

27. After the actual shipment of the order, the link provided by the shipping company to the customer is sent, whenever there is one, by sending an email with the same, which can also be consulted in your Client Area at any time. With this link it is possible to follow your order to its destination.

 

28. “Saddle Room” does not send status updates on the location of the order to customers.

 

29. It is the full responsibility of the customers the possible seizure of the respective orders, as well as the payment of customs fees, if any. In case of return of the products, “Saddle Room” will only refund the corresponding amount to the products, after receipt and verification of the same. If in doubt, please contact us before ordering.

 

30. All products sent by “Saddle Room” must be checked upon delivery. If you verify that the order is damaged, you must immediately return it to the shipping company, duly justify the reason for the return on the delivery note and immediately notify “Saddle Room” through one of our contacts.

The delivery period for orders can vary between 3 to 10 working days, but may exceptionally go up to 15 working days, in the case of production underload, or stockouts. “Saddle Room” will keep the customer informed by e-mail whenever the delivery period may be delayed, beyond 10 working days. Deliveries will be made via a carrier, with the customer being notified on the date the order is dispatched. Each shipment contains the following documents: Invoice and Return Form.

It is the customer's responsibility, upon receipt of the merchandise, to verify that it is in good condition, and that there is no shortage of volumes! If you find that any volume is damaged, or that any volume is missing, you MUST make a claim on the goods receipt document that the carrier presents to you for signing.

Shipping costs for the order are borne by the customer, calculated according to the total weight of the order and the destination delivery country. The amount of the expense is shown in the shopping cart, including VAT, and according to the two factors mentioned.

 

31. If after delivery, you find that any of the items is not in accordance with the order, please contact “Saddle Room” as soon as possible via email geral@saddle-room.com, indicating the order number and its elements, attaching the images of the package as it was received and of all the items in question, so that you can find out if there is anything that can be done, so that you can solve the problem.

 

32. Failure to pay for the order within 3 (three days) following the date on which it was placed implies the automatic cancellation of the order. The customer may cancel the order, immediately after payment and up to a maximum of 14 days (in non-personalized products), indicating the order number, to the e-mail: geral@saddle-room.com. The cancellation is only considered accepted after receiving a confirmation email from Saddle Room and, in this case, all amounts will be fully returned to the customer.

In the case of customized products, cancellations are not accepted, nor will any value be refunded, considering the start of production with the specificity of products made to measure and customized to the customer's taste.

 

33. “Saddle Room” recognizes to all its customers the right to terminate the contracts they enter with it, allowing them to return within 14 days of the products purchased under the terms of Decree-Law no. 143/2001 and Decree -Law 82/2008 of 05/20. To clarify any doubts, request additional information or send suggestions, please contact us.

 

34. All purchases made at the “Saddle Room” online store are subject to Portuguese legislation. Any conflict or divergence in the interpretation of the General Conditions of Online Sales will be submitted to the competent Portuguese Court.

 

35. Visitors and registered users of the “Saddle Room” website at www.saddle-room.com must use this website solely and strictly for legal purposes and may not access it in order to carry out practice or link to fraudulent acts or that result in a criminal offense, of trying and/or altering content, transmitting harmful messages or computer viruses or improperly using any of its content.

 

36. “Saddle Room” may prevent access and use of its website, www.saddle-room.com, without prior notification, whenever it considers that the visitor or user is knowingly violating the conditions defined herein or in any other way, to harm the normal functioning of the website or the rights of third parties.

 

37. If the Client is outside Mainland Portugal, “Saddle Room” informs you that any legal proceeding must be exclusively filed in the Portuguese Courts.
